KickstartSEO Terms and Conditions
KickstartSEO Terms and Conditions
Welcome to KickstartSEO - the SEO Fitness Specialists who take UK businesses from invisible to unmissable.
These Terms and Conditions set out how KickstartSEO Limited ("we", "us", "our") provides our SEO services to you. We've written them in plain English because life's complicated enough without legal jargon making it worse.
By using our services - whether that's our DIY tools, AI-powered assistance, or full done-for-you transformation - you're agreeing to these terms. We've kept them fair and straightforward, just like our approach to SEO.
We might update these terms occasionally (we'll email you if we do), but our core philosophy remains the same: we deliver service, sometimes free, sometimes at a fee. Sales is part of business, but service is our heartbeat.
We're SEO Fitness Specialists. Just like getting physically fit requires assessment, training, and maintenance, getting your website fit for search engines follows the same process. We offer three ways to help:
Optimiser Essentials (£49/month) - Professional SEO tools for businesses who prefer doing it themselves. You get the same tools we use, plus guidance when you need it. Because doing it yourself shouldn't mean doing it alone.
Optimiser AI (£129/month) - Norman, our AI strategist, does the heavy lifting while you maintain control. He analyses, creates, and implements improvements with your approval. It's like having a tireless SEO assistant who actually knows what he's doing.
Optimiser Premium (£299/month) - Complete SEO transformation while you run your business. Michael personally handles everything. Three-month minimum commitment because real transformation takes time.
All services include access to the KickstartSEO Portal - your SEO command centre where you can see exactly what's happening with your website's fitness journey.
We guarantee to provide our services with reasonable skill and care, using industry-standard SEO practices. Our relationship with you is built on delivering meaningful progress - measurable improvements in your website's search visibility, technical health, and overall SEO fitness.
What We Commit To:
What We Cannot Guarantee:
Meaningful Progress Definition:
"Meaningful progress" means demonstrable improvements in your website's SEO fitness over the service period. This includes technical improvements, content optimisation, ranking improvements for relevant keywords, and overall search visibility enhancement. We measure this through data available in your KickstartSEO Portal and regular reporting.
If you believe we're not delivering meaningful progress after a reasonable period (typically 3-6 months), we encourage you to discuss this with us first. We're committed to either demonstrating the progress being made or adjusting our approach to better serve your needs.
Our services are for businesses, not children. You must be 16 or older to use them.
As required by the Consumer Contracts Regulations 2013, here's the essential information about your purchase:
Our Identity:
KickstartSEO Limited
Enterprise House, Wrest Park, Silsoe, Bedfordshire MK45 4HR
Email: info@kickstartseo.co.uk
Phone: 01234 674100
Company Number: 15112092
Main Characteristics of Services:
Total Price: As displayed on our service pages (excluding VAT where applicable)
Payment: Monthly in advance via direct debit
Performance: Services begin immediately upon signup with Portal access
Duration: Ongoing monthly subscription (minimum 3 months for Premium)
Your Right to Cancel: 14-day cooling-off period as detailed below
Complaints: Email info@kickstartseo.co.uk or call 01234 674100
Under UK law, you have the right to cancel your service contract within 14 days of signing up, without giving a reason. This cooling-off period starts the day after you enter into the contract with us.
However, because our services are digital and we typically provide immediate access to the KickstartSEO Portal and begin work on your website straight away, we need your express consent to start services within this 14-day period.
By signing up for any of our services, you expressly request that we begin performance immediately and acknowledge that you will lose your right to cancel once we've started providing the service. This includes:
Additional Consumer Protections:
You have the right to cancel monthly services at any time with notice effective at the next billing period. For Optimiser Premium, you can cancel with 30 days' notice due to the intensive transformation work involved. No exit fees, no retention departments, no making it difficult to leave.
Primary Support (DIY Clients): Our primary support forum for DIY clients is the KickstartSEO group on Facebook.
Secondary Support: Zoom meetings scheduled in advance. Meeting length varies by service level.
Phone and Email Support: Phone support is limited, as is email support.
Our Working Hours: We appreciate that small businesses work odd hours. We respect that you might be hustling and grinding at 3 AM. However, we work Monday-Friday from 7 AM to 3 PM. We may respond outside those hours, but usually you can expect a response on the next business day. We respond based on what we are actually doing that day, and the urgency of the issue.
Holidays and Time Off: We take holidays and other time off. Living in the UK, if the sun comes out we are prone to disappear early and play golf. You accept that as a condition of working together.
When we take time-out, this time does not affect any of our agreements. In other words, you don't get 25% off a monthly fee if we take a 7-day holiday.
However, we still have a responsibility to meet minimum service commitments. We'll not let you get shortchanged because we take time off. It's a reality of doing business.
What We Actually Sell: We do not sell time, we sell experience and results. There is no commitment of set time on our behalf, but we commit to invest the time needed to get results and keep your loyalty.
You'll find current pricing on our product pages. No hidden fees, no surprise charges, no "contact us for pricing" nonsense.
If we're charging you more than our listed fees, it will be because we're doing something outside the box. If we're charging you less, you've probably been with us longer. Or maybe we just like you.
All prices exclude VAT where applicable.
Here's exactly how billing works:
Initial Setup:
When you subscribe, we'll create your account in our billing system and set up your KickstartSEO Portal access immediately. Within 2 business days, we'll issue your first invoice with payment due in 14 days - this aligns with your cooling-off period.
Example: If you sign up on 25 June, your first invoice will be due and collected on 9 July. Your next invoice will be generated on 18 July and collected on 25 July. From there forward, it's smooth sailing with monthly billing on the 25th.
Ongoing Monthly Billing:
The date of your initial invoice becomes your monthly billing date. After your initial invoice, all subsequent invoices are due 7 days after creation.
Note: Depending on when you sign up, you may have two payments collected in the same calendar month during your first month of service.
Direct Debit Setup:
All payments are taken by direct debit. You'll need to set up your direct debit mandate within 2 business days of subscribing to keep everything moving smoothly.
Why We Do It This Way:
Your 14-day cooling-off period begins when we provide Portal access and start work. By deferring your initial payment for 14 days, you get the full benefit of the cooling-off period without any payment pressure.
If payment fails, we'll contact you. We'll keep your service running for 10 days while you sort it out. After that, we'll pause your service until payment comes through.
We don't charge late fees unless you take the mickey (consistently late for months). We're running a business, not a debt collection agency.
Communication is key to overcoming these issues. If you stop talking to us, we'll assume the worst.
We might increase prices occasionally (inflation's a thing), but we'll give you 30 days' written notice via email. You can cancel without penalty during this notice period if you don't accept the increase. No sneaky mid-contract price hikes.
We try to avoid price increases; instead, we pass the cost of business on to new clients.
We comply with all applicable UK consumer protection laws, including the Consumer Rights Act 2015 and Digital Markets, Competition and Consumers Act 2024. We don't engage in unfair commercial practices, drip pricing, or use fake reviews.
Industry-Specific Compliance:
Fair Competition Practices:
We don't make misleading claims about SEO results, use fake testimonials, or employ tactics that could harm your website's long-term performance.
We work hard to keep our services running smoothly, but we're not superhuman. Sometimes things break - servers crash, internet connections fail, or the office cat walks across the keyboard.
We'll fix problems quickly, but we can't guarantee 100% uptime. Nobody can, despite what some providers claim.
If the software breaks, we accept that as part of using technology to deliver services. It's not ideal, but we'll get through it.
KickstartSEO Limited uses various software partners to provide our services, including the KickstartSEO Portal and what we call Norman. We've chosen services we know and trust from established technology providers.
We're not software developers, but we are SEO experts using commercially available software to deliver our services. You could potentially buy some of these services direct from software partners, but it's our combination of multiple services and our experienced use of these tools that makes KickstartSEO what it is.
Our value comes from knowing which tools to use, how to use them effectively, and interpreting the results to help your business. The technology is the vehicle - our expertise is what gets you where you need to go.
Any content you upload or create remains yours. We do not claim ownership of your website, business information, or brilliant blog posts. If you paid us to create it, you own it—it's that simple.
By using our services, you give us permission to work with your content - analyse it, optimise it, and make it better. That's literally what you're paying us to do.
The KickstartSEO Portal, Norman (our AI strategist), and all our clever technology remain our property. You can use them, but you can't copy, steal, or redistribute them.
We process personal data under the lawful basis of contract performance and legitimate business interests as detailed in our Privacy Policy. We handle your data according to UK data protection laws and our Privacy Policy. We don't sell your information, spam you unnecessarily, or do anything dodgy with your data.
If we receive intellectual property infringement claims regarding your content, we may suspend the disputed content pending resolution while you sort it out with whoever's complaining.
You can read our full Privacy Policy on our website, but the short version is: we use your data to provide our services and improve them. That's it.
Any service level can be cancelled at any time with appropriate notice.
Cancellation Notice Periods:
No Hassle Cancellation:
No exit fees, no retention departments trying to persuade you to stay, no making it difficult to leave. If you believe we're not delivering meaningful progress (as defined in Section 2), you should be free to go.
We can terminate your service if you:
Your access stops, but we'll give you a reasonable time to download any reports or data you need. We don't hold your data hostage either.
We're responsible for providing the services we promise using reasonable skill and care in accordance with applicable professional standards. If we mess up through our negligence, we'll fix it.
Mutual Fairness: While we limit our liability to protect against circumstances beyond our control, we also commit to:
Regarding Website Changes:
In broad terms, anything that can be done can be undone. If you draw an issue to our attention related to our SEO work, we will either sort it ourselves or tell you how to sort it (for DIY service clients). We stand behind our work.
What We Don't Do:
We are not marketing our services as website design or development. That's not what SEO is. However, we will use past experience to improve things when it can be done without an investment of our time or resources not agreed to.
This may, from time to time, include updating a plugin or code tweak on your behalf. If something goes wrong in this process, you release us from liability. We will make you aware of any issue we spot in the course of our work, so that you can have it sorted by a web designer or developer of your choosing.
Our maximum liability for any issue is limited to the total amount you've paid us in the previous 12 months. We can't be liable for lost profits, business opportunities, or indirect losses - SEO results depend on too many factors outside our control.
This limitation applies to all claims whether in contract, tort (including negligence), breach of statutory duty, or otherwise.
Nothing in these terms limits our liability for:
These terms, plus our Privacy Policy, are the complete agreement between us. Any previous conversations or agreements are superseded by these terms.
We might update these terms occasionally to reflect legal changes or business developments. If we make significant changes, we'll email you at least 30 days in advance. Continued use after the effective date means you accept the updated terms.
These terms are intended to be fair and balanced. They're written in plain English and all important terms are prominently displayed. If any term seems unclear, please ask us for clarification.
Nothing in these terms affects your statutory rights as a consumer under UK law. If any provision conflicts with your legal rights, your statutory rights take precedence.
We're reasonable people. If something goes wrong, let's talk about it before involving lawyers. If we can't sort it out, these terms are governed by English law, and any disputes go to English courts.
We do the best we can, but we don't know what we don't know. We rely on the internet working, the wifi being up and fast, and rivers not rising up the hill we live on. We're not liable for delays or failures caused by circumstances beyond our reasonable control.
If any part of these terms is found to be unenforceable, the rest remains valid. Courts may modify unenforceable provisions to the minimum extent necessary to make them enforceable. Think of it like removing one bad apple - the rest of the barrel is still good.
You can't transfer your rights under this agreement to someone else without our written consent. We may assign our rights and obligations to a third party, including in connection with a merger, acquisition, or sale of substantially all our assets, but we'll notify you if we do.
Succession Planning: We have a succession plan in place that protects our clients and stakeholders. In the event of Michael's demise, we would assign our software partner ownership of our clients enrolled in their software for continuity. Our software partner would then decide where to go from there. We have a procedure in place to let our software partner and our clients know if Michael shuffled off this mortal coil.
Questions about these terms? Email us at info@kickstartseo.co.uk or call 01234 674100. We're human beings who answer our own phones and emails.
